As noted in this State of Alaska webpage press release (and also noted by Michelle Malkin), the state of Alaska will be filing suit in federal court against U.S. Interior Secretary Dirk Kempthorne’s recent decision to list the polar bear as ‘threatened.’
Many individuals, including Hugh Hewitt and Kevin Hassett, have noted that, despite Secretary Kempthorne’s claims to the contrary, the nature of this ruling and the Endangered Species Act leaves open the means for lawsuits challenging any federal project that may emit greenhouse gases. If the state of Alaska’s suit is unsuccessful, expect legal chaos soon.
